These Terms & Conditions ("Terms") govern your use of the Zen Pool mobile application (the "App"), published on Google Play by the App's developer ("we", "us", "our"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.
The short version: Zen Pool is a free relaxation toy and game. It currently shows no ads, has no accounts, and stores everything only on your device — nothing about you is sent to us or anyone else. Use it for fun, don't try to break or misuse it, and understand it's provided "as is". Full detail below.
By installing or using the App you confirm that you can form a binding agreement with us and that you will comply with these Terms and all applicable laws. If you are using the App on behalf of a minor, you do so as the responsible adult and accept these Terms for them.
We grant you a personal, worldwide, royalty-free, non-exclusive, non-transferable and revocable licence to download and use the App on devices you own or control, for your own private, non-commercial enjoyment, in accordance with these Terms and the Google Play Terms of Service.
This is a licence, not a sale. We retain all rights not expressly granted to you.

The App and all of its content — including its name, artwork, shaders and visual effects, audio, text and design — are owned by us or our licensors and are protected by intellectual-property laws. Audio assets and the Flame game engine are used under their respective licences. Nothing in these Terms transfers any ownership to you.
Zen Pool is built to keep your information on your phone. It does not require an account, does not collect personal information, and in its standard release does not request internet access. Your high scores, your deepest dive, your settings and similar progress are stored only in your device's local app storage and are never transmitted to us.
How we handle information is described in full in our Privacy Policy, which forms part of these Terms.
At present, Zen Pool contains no advertising and integrates no advertising or analytics software.
We may introduce advertising in a future version of the App. If we do, we will update these Terms and our Privacy Policy, and the App's Google Play "Data safety" disclosures, before that version is released, and we will identify the ad provider(s) used (for example, Google AdMob). Advertising networks commonly collect device identifiers and usage information to deliver and measure ads; where the law requires it, we will ask for your consent. Your continued use of the App after such a change takes effect constitutes acceptance of the updated Terms.
Zen Pool currently contains no in-app purchases and no subscriptions. If paid features are added in future, any purchases will be processed by Google Play under Google's payment terms, and the applicable pricing, billing and refund rules will be disclosed in the App and on the store listing at that time.

The App also reads your device's local clock so the scene can run a little cosier at night and brighter by day. That reading happens entirely on your device and is never stored or sent anywhere.
The App is distributed through Google Play, and your download and use are also subject to the Google Play Terms of Service. We are not responsible for the practices of Google or of any third party whose software or content may be included in or added to the App in future; their own terms and policies apply to them.
We may update, change, suspend or discontinue the App (or any feature of it) at any time, and we may release updates that you need to install to keep using it. The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or compatible with every device.
Nothing in these Terms excludes or limits any rights you have under mandatory consumer-protection laws (including, where applicable, the New Zealand Consumer Guarantees Act 1993 or Australian Consumer Law) that cannot lawfully be excluded.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or in connection with your use of (or inability to use) the App. Because Zen Pool is provided free of charge, to the extent we may lawfully cap our liability, our total liability to you is limited to NZ$0.
Zen Pool is suitable for general audiences and contains no advertising and no data collection. We do not knowingly collect any personal information from anyone, including children. See the Privacy Policy for more.
We may revise these Terms from time to time. When we do, we will update the "Last updated" date above and, for material changes, draw attention to them through the App or store listing. Your continued use of the App after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of New Zealand, without regard to its conflict-of-laws rules, and you agree to the non-exclusive jurisdiction of the New Zealand courts. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.
